What changed

ICE agents shot and wounded 28-year-old Oscar Belgal during an attempted arrest in Marble Hill, New York, on 9 October, while his five-year-old son sat in the car. Belgal was detained, the child was unharmed, and the Department of Homeland Security defended the shooting as a response to a vehicle being used against officers.

New York Mayor Zohran Mamdani disputed that account, saying agents surrounded the car before opening fire and were difficult to identify. The number of ICE officers who fired remains under investigation.

Why it matters

The central dispute is not only whether Belgal accelerated toward officers. It is whether people at the scene could reasonably understand who was using force, and whether the presence of a child changed the danger officers faced or created.

Officials say Belgal resisted orders, struck two ICE vehicles and drove toward officers. Mamdani says agents wore construction vests and masks that concealed their faces. ICE body-camera footage has not been made public, so those competing accounts cannot yet be reconciled.

The confirmed record is narrower but serious: Belgal suffered a superficial neck injury from a bullet or fragment, was treated by NYPD officers and taken to hospital, then detained. The child was not hurt. NYPD footage shows the aftermath, including officers calling an ambulance and carrying Belgal into the hospital.

The political consequences are already clear. Mamdani has asked President Donald Trump to end ICE enforcement actions in New York, while DHS Secretary Markwayne Mullin has said enforcement will continue. That leaves the next phase focused on the evidence: the release of ICE footage, the investigation into which agents fired, and whether prosecutors or officials challenge either side’s account.

DHS has also cited Belgal’s alleged criminal history and alleged association with the Trinitarios. Those claims may shape how officials defend the operation, but they do not by themselves answer the immediate question of whether the shooting was justified.
