What changed
An Arizona appeals court has ordered Gabriel Paul Horcasitas, 55, to be resentenced after ruling that an AI-generated video of Christopher Pelkey, whom Horcasitas was convicted of killing during a 2021 road confrontation, improperly influenced his sentence. Horcasitas had received 10 years in prison; Pelkey’s family created the video from his recordings, photographs and videos, and showed it at the 2025 sentencing.
Why it matters
The ruling draws a sharp line between preserving someone’s voice and inventing what that person is thinking. The video showed an AI version of Pelkey offering forgiveness and saying he might have been friends with Horcasitas in another life. The court said that was not a recording of an event, but a depiction of the victim’s imagined thoughts.
That distinction now matters directly to the resentencing. A judge may hear the family’s grief and testimony, but the court has rejected this particular way of making the dead appear to speak for themselves. The next sentence is not yet known, and the ruling does not establish whether Arizona courts will apply the same reasoning more broadly to AI-generated victim statements.
